Peeping Toms in Ontario have more rights than their victims...

According to this story.

In a nutshell, a family installed surveillance cameras to protect itself from a man who was looking through their windows and masturbating. Now he's the one suing them...

How could any lawyer even take the case?

Let's just say this guy's privacy is toast anyway. I'd love to see the court case. What, he isn't going to show up or something? Moron...

Yet James Cedar, whose family retained the service of high-end St. Catharines lawyer George Walker -- most famous for "deal with the devil" plea arrangement for schoolgirl murderer Karla Homolka, wife of serial killer Paul Bernardo -- had the charge against him withdrawn.

It also looks like Cedar is participating in therapy. If the therapist is reporting to the court on his progress and level of meaningful involvement then pragmatically the deal makes sense.

So what the judge said, essentially, was that only voyeurs who break into your house or record you naked will get arrested. She sounds like she's saying those three women were "asking for it". Like you can't walk around in your own house. That kid is a creep who obviously is not getting cured by therapy and who deserves all the embarrassment the women he's traumatized can possibly throw his way.

So in your mind people aren't allowed to set up security cameras to monitor their own property? I don't know what the Constitution says where you live, but here in Canada, we have the rights to privacy and security in our own homes. We do NOT have the right to masturbate in view of the public, nor the right to violate the privacy rights of others, nor the right to trespass. If the Marshalls are punished for protecting themselves when the people responsible for keeping us safe did nothing, then I'll be very disappointed in my government. It would be a severe miscarriage of justice.

The bigger problem is that the attorney general (for no apparent reason) decided to withdraw charges against the peeping tom. Despite the guy being caught on camera and having given a confession.

Also, the guy only threatened to sue. He hasn't actually done so, nor has any judge ruled in his favor yet. Fortunately.

I agree-- I think the problem isn't that he has more rights, but that he's found a more brazen lawyer. Nothing says the lawyer will win, but unfortunately you can stress other people out and take up lots of their time with a lawsuit even if it turns out you lose it.

Yes, the fact they dropped any charges is profoundly disturbing. There was also mention somewhere that the voyeurism was "age-appropriate"... ???? wtf??? So because the guy isn't a pedophile, it's perfectly ok??? And if I kill a guy like this who's my age, does that let me off the hook, since criminal behaviour is all about your age?? These women are showering in the basement for heaven's sake. I had someone peeping through my windows as a teen and it was traumatizing, no matter how old the guy was.
