I can not believe the outcome of this case. It seems to defy all logic!
Not only does it show complete lack of respect for a pregnant womans rights over her own body, it puts the baby's life ahead of her own. I also believe I am not wrong in thinking that this sets a terrible prescident for women to be charged with a crime when they have an abortion, especially if it was late term.
The most annoying thing about this case is that the baby was born 100% healthy, despite the mothers refusal of a c-section. She was quite clearly making an informed decision! Despite this, her child remains in foster care and the reason seems to be that the hospital didn't like her attitude.
ARGH!

I read the articl and the case. As far as case precedence goes the article is uter bullshit. Case precedence from THAT case clearly states that when judging whether or not a woman is fit to be a mother- her decisions regarding medical care or refusal thereof for HER body should not be taken into consideration including but not limited to whether or not to have a c-section.
Now what DID hurt her case was 1) she kicked the ob out 2) called police on the ob 3) then claimed she wasnt being treated 4) thrashed about so much they couldnt give her the epidural she requested yet still went off on staff for not giving her one while she refused to be still or attempt being still 5) she is mentally ill lied about it and 6) when the courts gave her and her husband a road to get their baby back they refused to take it.
As a mentally ill woman she was probably NOT taking her meds for the sake of her baby but because of that maybe a c-section was best because at that point her behavior was unpredictable at best detrimental at worse.
